Congress Should Protect Our Constitutionally Guaranteed Freedoms, Not Threaten Our Most Basic Rights

Washington, D.C.

Congress should protect our constitutionally guaranteed freedoms, not threaten our most basic rights. The Fairness for All Act is a direct threat to First Amendment rights, and lawmakers should reject it.

The Fairness for All Act is presented as a compromise to the so-called Equality Act. But in reality, it simply expands government power to dictate how individual Americans should think, speak, and act – specifically when it comes to sexual orientation.

Under the Fairness for All Act, progressive views of sexual orientation and gender identity would be enshrined into law, removing the ability of any debate or disagreement in the public square. Though select religious institutions would get a special carve-out, ordinary Americans, including individuals, daycares, businesses, schools, and other institutions would see their First Amendment freedoms gutted.

In particular, the Fairness for All Act would threaten the liberty, equality, safety, and privacy of individuals in just some of the following ways:

  • Medical professionals would be forced to go against their best judgment to perform sex-reassignment therapies and surgeries on people, including children. They could be sued if they didn’t offer the “correct” treatment, despite risks and warnings for these drugs and surgeries.
  • Foster care agencies would be forced to promote transgender ideology and would not be allowed to seek any alternative counseling for foster children.
  • Single-sex spaces like homeless shelters, locker rooms, and showers would be open to men without regard to women and girls’ concerns about privacy and safety.
  • In public schools, boys and men would be allowed to participate in girls’ and women’s sports merely by declaring that they are female, when they are clearly not.
  • On Main Street, businesses with 15 or more employees would be forced to celebrate events and ideas that violate their deeply held beliefs.
  • The free exercise of faith would be virtually banned from the public square. Those who don’t conform to the new government orthodoxy would only be “free” inside the four walls of a religious institution.

All Americans should be free to peacefully think, speak, and act as they please without fear of punishment by the government. But proposals like Fairness for All force citizens to either conform or risk losing their jobs, businesses, athletic, or academic opportunities.

The Fairness for All Act masquerades as a compromise on religious liberty, but is in fact a religious liberty sell-out. It is a clear and present danger to every American’s First Amendment freedoms. Lawmakers must reject it.

The Conservative Action Project (CAP) was founded in 2008 by many conservative leaders, with former Attorney General Edwin Meese III serving as Founding Chairman. The group works to facilitate conservative leaders working together on behalf of common goals. CAP routinely issues "Memos to the Movement" demonstrating consensus among conservatives on key issues.
